Privacy Policy

This Privacy Policy explains what personal information we collect when you use www.daveandnathosting.com (the "Site"), book a stay with us, register your guests or contact us; how we use and share it; how long we keep it; and the choices and rights you have. English is the controlling version, except where Mexican law requires the Spanish version; the Spanish version is available at www.daveandnathosting.com/privacidad.


1. Who is responsible for your information

The company responsible for your personal information is Viva Houses Beyond Corp, a Florida corporation doing business as Dave & Nat Hosting ("we", "us", "our"), 600 Cleveland St, Suite 222, Clearwater, FL 33755, United States.

Our local operator in Mexico City, Viva Houses Bienes Raíces, S.A. de C.V. (the "Local Operator"), provides on-site services for your stay (check-in support, cleaning, maintenance and guest assistance) and handles your information on our behalf and under our instructions.

2. Information we collect

We collect only the information we need for the purposes in Section 3.

Information you give us

  • Booking and contact details: your name, email address, phone number, the House, dates, number of guests, price and the language you use on the Site.
  • Guest registration: before your stay we send you an online registration where you give the names of the people staying and a photo of each adult's official ID (passport, national ID or driver's license), and a contact email. Official IDs may show information such as nationality and date of birth. We do not use ID photos for facial recognition.
  • Guest account (optional): if you create an account, your name, email, phone number and password (which we store only as a one-way hash), and any profile details you choose to add, such as country, date of birth, language, spoken languages and whether you travel with pets. If you sign in with Google, Google shares your name and email address with us.
  • Messages: what you write to us through the chat on the Site, by email, by WhatsApp or by phone. When you use the Site chat we also keep the House and dates you were looking at, the page address and your IP address.
  • Reviews and reports: reviews you post about your stay and reports you make during your stay.

Information about payments

  • Payments on the Site are processed by Stripe, Inc. Your card number and security code go directly to Stripe; we never receive or store your full card number. From Stripe we receive the payment status, the payment method type, card brand, last four digits, the country of the card and the results of fraud and authentication checks.
  • If you pay with Klarna (only offered with the Non-Refundable Rate, when that rate is offered), Klarna collects the information it needs under its own privacy notice and tells us whether the payment was approved.

Information collected automatically

  • Acceptance record: when you accept our Terms and a cancellation policy at checkout, we record the exact text shown to you, the version and a fingerprint of that text (SHA-256), the date and time, your IP address, your browser information (user agent), your browser language, the page address, the text of the boxes you checked and the name you typed, if any.
  • Booking timeline: events related to your booking, such as the creation and result of your payment, the confirmation email we sent you and, if one occurs, a payment dispute.
  • Access records: some Houses have electronic locks. Their system records when the door is opened with a code. We may review these records for your security, for the security of the House, to help you if you have trouble getting in, and as evidence in a payment dispute.
  • Device and usage information: our servers record technical information about each visit (IP address, browser type, pages requested, date and time) to operate and protect the Site. We also use Google Analytics to understand how visitors use the Site (Section 6).

Sensitive information

We do not ask for sensitive personal information such as health data, religious beliefs, political opinions or sexual orientation. Please do not send it to us in messages.

3. How we use your information

To provide your booking (necessary purposes)

  • to quote, hold, book and charge your stay, and to send your confirmation and receipts;
  • to communicate with you about your booking and your stay, and to answer your questions;
  • to register the guests, give building access, protect the safety of guests, neighbors and minors, and meet local registration requirements;
  • to prevent fraud and misuse of the Site and of payment methods;
  • to process cancellations and refunds, and to respond to payment disputes and legal claims, using the acceptance record and the booking timeline;
  • to keep accounting and tax records and to comply with the law;
  • to operate the Site, keep it secure, keep you signed in and remember your chat conversation.

Additional purposes (you can say no)

  • to send you one reminder if you start a booking and do not finish it;
  • to send you a thank-you message after your stay with an invitation to book again;
  • to measure and improve the Site with statistics about its use.

You can object to these additional purposes at any time by writing to finanzas@viva-houses.com or by replying to the message. Saying no does not affect your booking.

We do not sell your personal information, we do not share it for targeted advertising by third parties, and we do not make decisions about you based solely on automated processing: payment disputes and similar decisions are reviewed by a person on our team.

4. Legal bases (for visitors from the European Union, the United Kingdom and similar laws)

Where the law requires a legal basis, we rely on: the performance of our contract with you (your booking and stay); legal obligations (accounting, tax and guest registration); our legitimate interests (preventing fraud, securing the Site, defending payment disputes and legal claims, measuring the use of the Site and sending the messages in Section 3 to our own guests), balanced against your rights; and your consent where the law requires it, which you can withdraw at any time.

5. How we share your information

We share personal information only as described here:

  • Local Operator: booking and guest registration details, so it can provide the on-site services of your stay.
  • Payment processors: Stripe and, if you use it, Klarna, to process payments, refunds and disputes and to prevent fraud.
  • Service providers that work for us under our instructions: hosting and servers, email delivery, booking and property-management software, messaging services (such as WhatsApp), electronic-lock systems, analytics (Google Analytics) and data backup.
  • Card issuers, card networks and payment providers, when you dispute a charge, as described in Section 14 of our Terms.
  • Authorities, when the law requires it (for example, guest registration rules, a court order or a tax requirement), and when necessary to protect the rights, property or safety of our guests, neighbors, our team or the public.
  • A buyer or successor of our business, if we are involved in a merger, sale or reorganization; we will tell you and they must respect this Policy.

We do not share your personal information with third parties for their own direct marketing.

6. Cookies and similar technologies

We use cookies and similar technologies:

  • Necessary: a session cookie and a security token that keep you signed in, protect forms, remember your language and make checkout work.
  • Chat: a cookie for each House page where you use the chat, so that your conversation is still there when you return, for 30 days.
  • Analytics: Google Analytics sets cookies to count visits and measure how the Site is used. We configured it with IP anonymization and with Google signals and ad personalization turned off. Google may collect information about your visits to this and other websites over time. You can opt out with the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout) or by blocking cookies in your browser.
  • Payments: on the checkout page, Stripe may set cookies and collect device information to prevent fraud, under Stripe's privacy policy.
  • Third-party content: some pages load fonts, maps and scripts from third-party providers, which receive your IP address when your browser requests that content.

You can block or delete cookies in your browser settings; if you block necessary cookies, parts of the Site (such as checkout) may not work.

Do Not Track. Our Site does not currently change its behavior in response to "Do Not Track" or similar browser signals.

7. International transfers

We are based in the United States and the Houses are in Mexico, so your information is processed in the United States and in Mexico, and it may be processed in other countries where our service providers operate. When we transfer information across borders we use service providers that protect it under their contracts with us and, where the law requires it, the safeguards that law provides.

8. How long we keep your information

  • Booking, payment, acceptance record and booking timeline: 5 years after your check-out date, so that they are available for accounting and tax purposes and if a payment dispute or legal claim is raised.
  • Messages: as long as needed to serve you and as part of the booking record above.
  • Guest registration and ID photos: only as long as needed for the purposes in Section 3 and for the legal periods that apply to us; after that we delete or anonymize them.
  • Guest account: until you ask us to delete it, except information we must keep for the periods above.
  • Analytics: according to the retention settings of Google Analytics, in pseudonymous form.

9. How we protect your information

We use reasonable administrative, technical and physical safeguards appropriate to the information we hold. For example, card numbers are handled by Stripe and never stored by us, ID photos are stored in private storage with restricted access, and passwords are stored only as one-way hashes. No system is completely secure; if a security incident affects your personal information, we will notify you and the authorities as the law requires.

10. Your choices and rights

Review and correct your information. If you have a guest account, you can review and update your profile in your account settings. You can also ask us, at any time, to review, correct or update the information we hold about you.

Your rights. Depending on where you live, you may have the right to: know what personal information we hold about you and receive a copy (access); correct it (rectification); ask us to delete it (cancellation or erasure); object to or restrict its use, including for the additional purposes in Section 3 (opposition); receive it in a portable format; and withdraw a consent you gave. Some rights are subject to legal limits; for example, we must keep booking and payment records for the periods in Section 8.

How to make a request. Email finanzas@viva-houses.com with the subject "Privacy request", including your name, the email or phone number you used with us, what you are asking for and, if you are acting for someone else, proof that you may do so. To protect you, we may ask you to confirm your identity before we act on a request. We reply within 20 business days and, if your request is granted, we carry it out within 15 business days after our reply. We do not charge for requests, except reasonable costs where the law allows it, and we will not treat you differently for exercising your rights.

Marketing messages. You can stop the reminder and thank-you messages in Section 3 at any time by replying to them or writing to us.

Complaints. You can also contact the data protection authority where you live. In Mexico, the authority for personal data held by private companies is the Secretaría Anticorrupción y Buen Gobierno. In the European Union and the United Kingdom, you may complain to your local data protection authority.

United States. Some U.S. states give their residents specific privacy rights. Where a state privacy law applies to us, we will honor the rights it gives you; you can make a request as described above. California residents: we do not share personal information with third parties for their direct marketing purposes.

11. Additional information for guests in Mexico (Aviso de privacidad)

This Section, together with the rest of this Policy, is our privacy notice under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.

  • Responsible party: Viva Houses Beyond Corp, 600 Cleveland St, Suite 222, Clearwater, FL 33755, United States; contact finanzas@viva-houses.com. The Local Operator in Mexico City processes your information on our behalf.
  • Personal data we process: identification and contact data, booking data, payment data (without full card numbers), guest registration data including images of official IDs, communications, and the technical and acceptance records described in Section 2. We do not process sensitive personal data.
  • Purposes: the necessary purposes and the additional purposes listed in Section 3. If you do not want your data used for the additional purposes, write to finanzas@viva-houses.com at any time.
  • Transfers: we transfer data without needing your consent only in the cases the law allows: to authorities when required by law; to card issuers, card networks and payment providers when necessary to fulfill our contract with you or to exercise or defend our rights in a dispute; and to the Local Operator, a company of our group. Service providers that process data on our behalf receive it under our instructions.
  • ARCO rights and revocation of consent: you can exercise your rights of access, rectification, cancellation and opposition, revoke your consent and limit the use or disclosure of your data through the procedure in Section 10.
  • Cookies: described in Section 6.
  • Changes to this notice: published as described in Section 13.

12. Children

The Site is not directed to children, and bookings must be made by adults of at least 18 years old. We do not knowingly collect personal information from children under 13 through the Site. Information about minors staying at a House is provided by their parent or guardian as part of guest registration and is used only for the purposes in Section 3.

13. Changes to this Policy

We may update this Policy. We will publish each new version on this page with its version number and "Last updated" date, and, if the changes are material, we will also tell you by email or by a notice on the Site before they apply to you. Previous versions remain available at www.daveandnathosting.com/privacy/v1 (and the corresponding address for later versions).
