Booking Terms and Conditions

Seller and merchant of record: Viva Houses Beyond Corp, a Florida corporation, doing business as Dave & Nat Hosting. English is the controlling version of these Terms; a Spanish translation is available on the Site (see Section 18.2).


Key terms at a glance

These points are also shown to you before you pay. The full Terms below govern.

  1. Who you are buying from. Your booking is a contract with Viva Houses Beyond Corp, a Florida corporation doing business as Dave & Nat Hosting. It is the company that charges your payment method.
  2. How the charge appears on your statement: VIVABEYOND* RES followed by your booking number (for example, VIVABEYOND* RES12345).
  3. You pay the full price when you book. The total shown before you pay includes the nightly rates (with any discount, such as a last-minute discount), cleaning, extra-guest fees and taxes (Mexican value-added tax of 16% and lodging tax of 5%).
  4. Cancellation. Each House has its own cancellation policy, shown on the House page and next to the pay button. When a Non-Refundable Rate is offered and you choose it, it costs less and is not refunded, except within the 24-hour window described in Section 7.2.
  5. Refunds are net of payment-processing costs. When you receive a refund because you cancel or change your booking, we deduct the fees our payment processors actually charged us for your payment and do not return to us, shown to you line by line, and never more than 7% of that payment (Section 8). Nothing is deducted if we cancel or cannot provide your stay, for duplicate or unauthorized charges, or for the return of a deposit.

1. Who we are and who you contract with

1.1 The seller. These Terms are a contract between you and Viva Houses Beyond Corp, a Florida profit corporation (Florida Division of Corporations document number P25000014526), with its principal address at 600 Cleveland St, Suite 222, Clearwater, FL 33755, United States, doing business as Dave & Nat Hosting ("we", "us", "our"). We are the seller of the accommodation you book on www.daveandnathosting.com (the "Site") and the merchant that processes your payment.

1.2 The houses. The houses and apartments offered on the Site (each, a "House") are located in Mexico, mainly in Mexico City. On-site services (check-in support, cleaning, maintenance and guest assistance) are performed on our behalf by our local operator in Mexico City, Viva Houses Bienes Raíces, S.A. de C.V. (the "Local Operator"). The Local Operator acts for us; your contract and your payment are with us.

1.3 Who these Terms apply to. These Terms apply to bookings made on the Site. The person who makes the booking (the "Lead Guest") accepts these Terms for everyone in the party and must make sure that everyone follows them.

1.4 Your statement. Your payment appears on your card statement as VIVABEYOND* RES followed by your booking number. We show this descriptor before you pay and in your confirmation email. If you do not recognize a charge from us, please contact us before contacting your bank (Section 14).

2. Definitions

  • "Booking": a reservation of a House for specific dates, confirmed by us under Section 3.
  • "Check-in Time" and "Check-out Time": the times shown on the House page and in your confirmation.
  • "Cancellation Policy": the cancellation policy of the House you book, as shown on the House page and next to the pay button.
  • "Non-Refundable Rate": the rate described in Section 7.2, available only when we offer it.
  • "Payment-Processing Costs": defined in Section 8.2.
  • "Total Price": the amount shown before payment and charged at booking, as described in Section 4.
  • "Mexico City time": the official time of Mexico City (America/Mexico_City).

3. How a booking is made and confirmed

3.1 Steps. You choose a House, dates and number of guests. Before you pay, the Site shows you a booking summary with: the House, the dates, the number of nights and guests, the price breakdown and the Total Price, the full Cancellation Policy of your booking including the payment-processing cost rule in Section 8, and how the charge will appear on your statement.

3.2 Your acceptance. To pay you must check two boxes, both unchecked at the start: (a) one confirming that you have read and accept the Cancellation Policy of your booking, and (b) one confirming that you accept these Terms and the House Rules and that you have read our Privacy Policy. When the Non-Refundable Rate is offered and you choose it, you may also be asked to type your full name. By checking the boxes and completing payment you sign and agree to these Terms electronically, with the same effect as a handwritten signature, under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Florida Uniform Electronic Transaction Act (Section 668.50, Florida Statutes).

3.3 Hold on the dates. When you continue to payment, we hold the dates for 20 minutes. If payment is not completed within that time, the hold is released and the dates may be booked by someone else. If the price of your dates changed in the meantime, we show you the new Total Price and ask you to accept again before you pay.

3.4 When the contract is formed. The Booking is confirmed, and the contract is formed, when your payment succeeds and we send you a confirmation email with your booking number. If your payment is declined, no Booking exists and nothing is charged. If a payment succeeds but we cannot confirm the dates, we will tell you promptly and refund 100% of what you paid, with no deduction.

3.5 Record of your acceptance. When you accept, we keep a record of: the version of these Terms and of the Cancellation Policy shown to you, each with a unique fingerprint of its text (SHA-256); the exact text displayed to you; the date and time; your IP address; your browser information and language; the text of the boxes you checked; the name you typed (if any); and the confirmation email we sent you. This record is the evidence of our agreement. Section 15 and our Privacy Policy explain how we protect it.

3.6 Confirmation. Your confirmation email states that your payment is an advance payment (prepayment), repeats the Total Price, dates and the Cancellation Policy you accepted, shows the House address and how the charge will appear on your statement, includes a link to the version of these Terms you accepted, and gives our contact details. Please keep it.

3.7 Eligibility. The Lead Guest must be at least 18 years old, must stay at the House during the Booking, and must provide accurate contact details. A booking made for someone else must name the person who will stay.

4. Price

4.1 What the Total Price includes. The Total Price is shown before you pay and includes: the nightly rate for each night of your stay; any discount that applies to your dates (for example, a last-minute discount), reflected in the price shown; the cleaning fee; extra-guest fees, if your party is larger than the number of guests included in the nightly rate; and taxes (Section 5). There are no other mandatory fees.

4.2 Damage deposit. Most Houses do not require a damage deposit. If the House page shows a refundable damage deposit, its amount is shown as a separate line before you pay, marked as refundable, and it is handled as described in Section 12. It is not part of the price of your stay.

4.3 Price changes. A discount applies only to the dates, House and conditions shown in your quote. The price you pay is fixed once your Booking is confirmed; later price changes, up or down, do not affect it.

4.4 Currency. Prices are shown and charged in the currency shown at checkout, normally U.S. dollars (USD). If your card is in another currency, your bank converts the amount and may charge its own foreign-transaction or conversion fee; those fees are set by your bank and are not charged or received by us.

4.5 Same price for every payment method. We do not add any surcharge or fee for paying by card, by digital wallet or with any other payment method we accept.

5. Taxes

5.1 The Total Price includes the taxes that apply to lodging in Mexico: Mexican value-added tax (IVA) at 16% and the lodging tax (Impuesto sobre Hospedaje) at 5%, shown together as one "Taxes" line, calculated on the price of the stay (nights, cleaning and extra-guest fees, after discounts).

5.2 If tax rates change after your Booking is confirmed, we will not charge you the difference.

5.3 Receipts and invoices. Your confirmation email is your receipt. If you need a tax invoice, write to finanzas@viva-houses.com within 30 days after check-out with your tax details; we will tell you which invoice can be issued for your Booking under the applicable tax law and, where one can be issued, send it to you.

6. Payment

6.1 Full payment at booking. You pay the Total Price in full when you book. This is an advance payment for your stay.

6.2 Payment methods. We accept the cards and digital wallets shown at checkout. Payments are processed by our payment processor, Stripe, Inc. We never see or store your full card number.

6.3 Klarna. When the Non-Refundable Rate is offered, you may also be able to pay it with Klarna, if you are eligible. Klarna is offered only with the Non-Refundable Rate. If you pay with Klarna, Klarna decides whether to approve you and which plans you can use, and your repayment agreement is with Klarna. For us, your Booking is paid in full when Klarna approves the payment. Refunds, where due, are processed through Klarna (Section 8.7).

6.4 Authentication. Your bank may ask you to confirm the payment (for example, with a code). We may require this for some bookings to protect you against fraud.

6.5 Declined or reversed payments. If your payment is declined, no Booking is created. If a payment is later reversed for a reason other than a dispute you are entitled to raise, we will notify you and give you 72 hours to pay before we cancel the Booking.

7. Cancellation

7.1 Cancellation Policy of each House. Each House has one of the following Cancellation Policies. The policy that applies to your Booking is shown on the House page, next to the pay button and in your confirmation:

In every case the refund is calculated on the Total Price paid and is net of Payment-Processing Costs (Section 8). Days are counted back from the Check-in Time on your arrival date, in Mexico City time. If the policy shown to you when you paid differs from this table, the one more favorable to you applies.

7.2 Non-Refundable Rate (when offered). We may offer a Non-Refundable Rate for some Houses and dates. When offered, it is shown next to the regular price before you pay, and:

  • (a) the nightly rate is 10% lower than the regular nightly rate; cleaning and extra-guest fees are not discounted, and taxes are calculated on the reduced price;
  • (b) no refund is given if you cancel, change your dates (except as allowed in Section 9.2), do not show up, or leave early;
  • (c) 24-hour window: if you book at least 7 days before the Check-in Time, you may cancel within 24 hours after we send your confirmation and receive a refund of the Total Price net of Payment-Processing Costs (Section 8); bookings made less than 7 days before check-in have no such window;
  • (d) Section 10 (if we cancel or cannot provide your stay) always applies.

7.3 How to cancel. Write to finanzas@viva-houses.com, or contact us by phone or WhatsApp at +52 55 1587 7121, with your booking number. The time of cancellation is the time we receive your request, as recorded by our systems. We confirm your cancellation by email with the refund amount, if any.

7.4 No-show, late arrival, early departure. If you do not arrive, arrive late, or leave early, the unused nights are not refunded, except where Section 10 applies.

7.5 Personal circumstances. Cancellation Policies apply even if you cancel because of illness, travel disruption, or other personal circumstances. We recommend travel insurance. Events that prevent us from providing the House are covered by Section 10.

8. Refunds and payment-processing costs

8.1 When this Section applies. Whenever you receive a refund because you cancel or change a Booking (within the refundable period of the Cancellation Policy, within the 24-hour window of the Non-Refundable Rate, or as a courtesy we are not required to give), the amount we refund is:

Refund = the amount refundable under your Cancellation Policy − the Payment-Processing Costs of the payment being refunded.

8.2 What Payment-Processing Costs are. "Payment-Processing Costs" are the fees actually charged to us, for the specific payment being refunded, by the payment processor that handled it: Stripe, Inc. and, if you paid with Klarna, Klarna. These providers keep their fees when a payment is refunded, so the cost remains ours even though your stay does not take place. Payment-Processing Costs are a cost of your cancellation. They are not a fee for using any payment method: the Total Price is the same whatever payment method you use, and nothing is deducted if your stay goes ahead.

8.3 How much. We deduct the exact amount charged to us for that payment, with no markup. For reference, on the date of this version our processors charge:

In no case will we deduct more than 7% of the amount of that payment, nor more than the amount otherwise refundable. If your Booking was paid in more than one payment, the costs of each payment that is refunded apply to that payment. If our processors charge us less, we deduct less.

8.4 Itemized statement. When we issue a refund, we send you an itemized statement showing: the amount you paid; the refund percentage under your Cancellation Policy; the amount refundable under the policy; the Payment-Processing Costs, with the payment method (brand and last four digits) and the processor's fee for that payment; and the net amount refunded. If you ask within 90 days of the refund, we will provide a copy of the processor's record of the fee charged on your payment, with unrelated information removed.

8.5 When nothing is deducted. We refund without deducting Payment-Processing Costs when:

  • (a) we cancel your Booking, or we cannot provide the House or an equivalent accommodation under Section 10;
  • (b) the charge was duplicated, made in error, or not authorized by you, including fraud;
  • (c) we return a damage deposit (Section 12);
  • (d) a payment succeeded but the Booking could not be confirmed (Section 3.4); or
  • (e) applicable law gives you the right to a full refund or to withdraw without cost (see Section 16.5 for consumers in Mexico).

8.6 Disclosure and agreement. This rule is shown to you before you pay, as part of the Cancellation Policy of your booking, and you accept it with the checkbox described in Section 3.2. It is repeated in your confirmation email.

8.7 How and when refunds are paid.

  • (a) We issue the refund within 10 business days after we approve it (for a cancellation, after we confirm your cancellation). Your bank or card network may take up to 10 additional business days to show it on your statement.
  • (b) Refunds go to the original payment method. If that is no longer possible (for example, the card was closed), we will refund to another card in your name or by bank transfer to an account in your name, at no cost to you.
  • (c) Klarna: refunds are made through Klarna, which reduces or cancels your remaining installments and returns any amount already paid. If Klarna no longer allows a refund on your payment, we refund by bank transfer to an account in your name, at no cost to you.
  • (d) Refunds are made in the currency of your payment. Differences caused by your bank's exchange rates or fees are not ours to cover.

9. Date changes and other modifications

9.1 Regular price. You may ask to change dates or the number of guests. Changes depend on availability and on our written confirmation. The new price is the current price for the new dates. If it is higher, you pay the difference when the change is confirmed. If it is lower, the difference is treated as a partial cancellation on the date of your request and is refunded according to your Cancellation Policy and Section 8.

9.2 Non-Refundable Rate: date change with credit. You may ask to move a Non-Refundable Rate Booking to new dates once, at least 7 days before the original Check-in Time, subject to availability and our written confirmation:

  • (a) everything you paid is applied in full as credit to the new dates (no Payment-Processing Costs are deducted, because nothing is refunded);
  • (b) the new stay must be in the same House, or in another House if we agree in writing, and must begin within 12 months of the original check-in date;
  • (c) if the new dates cost more at the current Non-Refundable Rate price, you pay the difference when the change is confirmed;
  • (d) if the new dates cost less, the difference is not refunded and no credit remains;
  • (e) the new Booking remains non-refundable and cannot be changed again.

9.3 Extensions and extra guests are subject to availability, the current price and the House's maximum occupancy.

10. If we cancel or cannot provide your stay

10.1 Our commitment. If we cancel your Booking or cannot provide the House (for example, because of a double booking, a serious defect, or any other cause attributable to us), we will tell you as soon as we know and you may choose:

  • (a) relocation to an accommodation of equal or better category, size and location, at no additional cost to you (we pay any price difference);
  • (b) new dates in the same House at the same price, subject to availability; or
  • (c) a full refund of everything you paid, with no deduction of Payment-Processing Costs.

10.2 During your stay. If something important does not work (for example, water, electricity, hot water, access, or a safety issue), tell us right away. If we cannot fix it within 24 hours and the problem was not caused by you or your party, we will offer you relocation or a refund of the affected nights, with no deduction.

10.3 Events beyond anyone's control. If a natural disaster, government order, or similar event beyond our reasonable control makes it impossible for us to provide the House on your dates, we will offer you new dates or a full refund, at your choice, with no deduction.

10.4 Consumers in Mexico also have the rights described in Section 16.5.

11. Check-in, identification and House Rules

11.1 Check-in and check-out. Check-in and Check-out Times are shown on the House page and in your confirmation. Early check-in or late check-out depends on availability and must be confirmed in writing.

11.2 Identification (House Rule). Before or at check-in, each adult guest must present a valid official photo ID (passport, national ID or driver's license) through the online guest registration we send you or in person. We use it to register the guests, to give building access, for the safety of guests and neighbors, and to protect minors as required by local rules. This is a House Rule; it is not a condition of paying or of using any payment method. Minors must stay with a parent or legal guardian, or with the guardian's written authorization. If a guest refuses to identify, we may deny access to that guest.

11.3 House Rules. Each House has House Rules shown on its page, which form part of these Terms. In all Houses:

  • (a) the number of guests may not exceed the maximum shown; visitors need our prior approval;
  • (b) parties and events are not allowed;
  • (c) quiet hours are from 10:00 p.m. to 8:00 a.m., Mexico City time, and building or condominium rules must be followed;
  • (d) smoking is not allowed indoors; pets are allowed only where the House page allows them;
  • (e) no illegal activity, and no sub-letting or commercial use without our written consent.

11.4 Serious breach. If a guest seriously breaches the House Rules (for example, a party, exceeding occupancy, illegal activity, or a risk to people or property), we may, after a warning, or immediately if there is a risk to safety, end the stay. Unused nights are not refunded in that case, and documented costs caused by the breach are handled under Section 12.

12. Damage deposit and damage

12.1 Deposit. If the House page shows a refundable damage deposit, the House page and the checkout show its amount and how it is collected before you pay. The deposit is never used to pay for your stay, and your advance payment for the stay is never used to pay for damage.

12.2 Return. We return the deposit in full, without deducting Payment-Processing Costs, within 14 days after check-out, unless we notify you of damage under Section 12.3 within that period.

12.3 Damage. You are responsible for damage, loss or extraordinary cleaning caused by you or your party beyond normal wear. If we make a claim, we will, within 10 business days after check-out, send you an explanation, photos, and a quote or invoice for the actual cost of repair or replacement. You may send us an alternative written quote within 10 business days of receiving ours. We only claim the actual cost.

12.4 Payment of damage. We first apply the deposit, if any. For any amount above the deposit, you may pay by any method we accept; paying damage with the card used for the Booking is optional. Unless you agree, we will not charge your card for damage earlier than 20 business days after sending you the documentation, and you keep the right to dispute that charge with your bank.

13. Responsibility

13.1 We are responsible for providing the House as described and the services in these Terms, and for damage caused by our fault or by the people who act for us.

13.2 We are not responsible for: (a) events beyond our reasonable control, subject to Section 10.3; (b) services provided by third parties that you contract directly (for example, transport or tours); (c) loss of or damage to your belongings, unless caused by our fault; (d) temporary interruptions of public services not caused by us, subject to Section 10.2.

13.3 To the extent permitted by law, our total liability arising from a Booking is limited to the amount you paid for it. This limitation does not apply to death or personal injury, gross negligence, willful misconduct, or any liability that the law does not allow to be limited, and it does not apply to consumers covered by Section 16.5 where Mexican law does not permit it.

13.4 Nothing in these Terms restricts your right to post honest reviews about your stay.

14. Payment disputes (chargebacks)

14.1 Talk to us first. If you do not recognize a charge, think a refund is due, or are unhappy with your stay, please write to finanzas@viva-houses.com or contact us at +52 55 1587 7121 (phone and WhatsApp). We aim to reply within one business day, and most issues are solved faster than through a bank dispute.

14.2 Your rights are not limited. Nothing in these Terms limits your right to dispute a charge with your card issuer or payment provider. We will never ask you to give up that right.

14.3 How we handle disputes. Every dispute is reviewed by a person on our team, never decided automatically. To respond, we may provide to your card issuer, to the card network, to Stripe and, if you paid with Klarna, to Klarna, the records of your Booking: the booking details and price; the Cancellation Policy and Terms you accepted and the record described in Section 3.5; the confirmation and other emails we sent you; our communications with you; and evidence that the House was available or used (for example, the guest registration and, where the House has an electronic lock, access-system records). We keep this evidence for the periods stated in our Privacy Policy.

14.4 No double refunds. If you receive a refund from us and also a credit from your card issuer or payment provider for the same amount, you must return the duplicate amount to us.

15. Personal data

Our Privacy Policy, published at www.daveandnathosting.com/privacy (Spanish: /privacidad), explains what data we collect and how we use it: to manage your Booking, to register guests as required by local rules, to prevent fraud, and to defend payment disputes. We share payment data with Stripe and, if you use it, Klarna, and booking data with the Local Operator. We keep the acceptance record in Section 3.5 for 5 years after your check-out date so that it is available if a dispute or claim is raised.

16. Governing law and resolution of disputes

16.1 Informal resolution. Before starting any legal claim, please contact us so we can try to solve it within 30 days. This does not apply to, and does not delay, a dispute you raise with your card issuer or payment provider, or a complaint you file with a government agency.

16.2 Governing law. These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law rules. Local rules of the place where the House is located, on the use of the House (for example, civic rules and guest registration) also apply to your stay.

16.3 Courts. Any dispute between you and us arising out of these Terms or a Booking will be decided by the state or federal courts located in Pinellas County, Florida, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in a small-claims court with jurisdiction, including the small-claims division of the County Court for Pinellas County, Florida, or the small-claims court where you live. Nothing in this Section limits your rights under Sections 16.4 and 16.5, or your right to contact a consumer protection agency.

16.4 Consumers in other countries. If you are a consumer resident in a country whose law gives you mandatory protections that cannot be waived by contract, nothing in these Terms deprives you of them.

16.5 Consumers in Mexico. If you are a consumer resident in Mexico, or where Mexican consumer law otherwise applies: (a) you keep all rights under the Mexican Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), which cannot be waived; (b) you may file a complaint with the Federal Consumer Protection Agency (PROFECO), www.gob.mx/profeco, phone 55 5568 8722 or 800 468 8722; (c) Sections 13.3 and 16.3 do not apply to you to the extent Mexican law prohibits them, and you may bring your claim before the competent authorities in Mexico; (d) if we fail to provide the service for causes attributable to us, you are entitled to the compensation provided by Mexican consumer law in addition to Section 10; (e) if the law grants you a right to withdraw from the Booking, you may exercise it and receive a full refund, without deduction of Payment-Processing Costs; and (f) the Spanish version of these Terms is available on the Site and, where Mexican law requires it, prevails.

18. General

18.1 Changes. We may update these Terms for future bookings. Your Booking is governed by the version you accepted; a later version applies to it only if it is more favorable to you. Each version is published with its version number and date, and remains available at www.daveandnathosting.com/terms/v1 (and the corresponding address for later versions).

18.2 Language. These Terms are written in English, which is the controlling version, subject to Section 16.5(f). A Spanish translation is available at www.daveandnathosting.com/terminos.

18.3 Entire agreement. These Terms, the House Rules of your House, the Cancellation Policy shown to you, your booking confirmation and our Privacy Policy are the entire agreement between you and us about your Booking.

18.4 Severability; no waiver. If a provision is found invalid or unenforceable, the rest remains in force. Not enforcing a provision is not a waiver of it.

18.5 Notices. We send notices to the email address you gave us; you can reach us at the contact details in Section 17.

18.6 Assignment. You may not transfer your Booking without our written consent. We may assign these Terms to a company of our group, with notice to you, without reducing your rights.
